Michael Huston Led Two U.S. Supreme Court Cases in 2024-2025 Term
WASHINGTON, D.C. (May 1, 2025)—Perkins Coie is pleased to announce that partner Michael Huston, firmwide chair of the Appeals, Issues & Strategy practice, led two cases heard by the Supreme Court of the United States during the Court’s just-concluded 2024-2025 Term. The cases marked the 10th and 11th time that Michael has argued before the Supreme Court.
In EPA v. Calumet Shreveport Refining, Michael argued on behalf of a coalition of small petroleum refineries challenging the Environmental Protection Agency’s (EPA) denial of their petitions for hardship relief from the Renewable Fuel Standard. The case addresses whether Clean Air Act lawsuits must be brought in the federal appellate court in Washington, D.C., where the EPA is headquartered, or should instead be brought in the regional circuit courts where the petitioning refineries are located. In addition to Michael, the Perkins Coie team included partners LeAnn Johnson Koch, Alexandra Bromer, Jonathan Hardin, and Sopen Shah; counsels Aimee Ford and Karl Worsham; and associate Jordan Buckwald.
In Parrish v. United States, Michael was appointed by Order of the Supreme Court to defend a court-of-appeals judgement as amicus curiae. The case raises the question whether a litigant who misses the deadline to file a notice of appeal, but whose window to appeal is reopened by a district court, must file a notice of appeal during the reopened window. Michael was supported by a Perkins Coie team consisting of senior counsel Jacob Taber; counsel Karl Worsham; and associates Addison Bennett, Jordan Buckwald, and Victoria Romine.
