The California Department of Industrial Relations Updates Its PAGA FAQs Following Legislative Reforms
The California Department of Industrial Relations recently updated its Frequently Asked Questions (FAQs) regarding how claims brought under the Private Attorneys General Act (PAGA) will be handled following recent reform legislation.
As we previously reported here, on July 1, 2024, Governor Gavin Newsom signed into law Assembly Bill 2288 and Senate Bill 92, memorializing reforms to PAGA. The legislation applies to PAGA notices and any resulting PAGA actions filed on or after June 19, 2024.
The FAQs, updated in October 2024, now address certain aspects of the legislative reform, including standing, the percentage of recovered penalties allocated to employees, and the updated cure process.
