Climate Legislation & Policy
We are actively involved in climate policy development at the federal, state, and local levels, including serving as lead counsel for a coalition of utilities negotiating and drafting the Washington Clean Energy Transformation Act. Our team includes a former associate director at the President’s Council on Environmental Quality in Democratic and Republican administrations, who worked on assessment guidance under the National Environmental Policy Act.
We advise clients on trade policy, emissions assessment, carbon sequestration projects, and carbon reduction legislation such as the Virginia Clean Economy Act. We have also helped clients increase carbon-free energy use in regions of the U.S. where organized wholesale markets currently do not exist.
Greenhouse Gas Legislation
Clients turn to us for guidance on compliance with federal, state, and local greenhouse gas regulations. We have counseled clients on emission requirements and mitigation opportunities, as well as regulatory developments including those associated with the Clean Air Act, Washington state’s Climate Commitment Act, and other federal and state environmental statutes.
Corporate Climate Pledges
Clients turn to us for help developing and implementing carbon reduction strategies. We advise on emissions mitigation, carbon-free energy commitments, transactional agreements and deal structures, renewable power purchases, contracting and verification processes, and climate-related regulatory issues. Our clients have included major technology companies and public utility companies including Alliant Energy and Puget Sound Energy.
Carbon Offset & Sequestration Project
Clients seek our help in the development and monetization of carbon offset and sequestration projects. We provide strategic advice to lead investors involved in potential multibillion-dollar projects to generate carbon reduction credits from tropical forest restoration, sustainable agroforestry, and conservation. We have counseled clients on Section 45Q tax credits, potential public funding opportunities and opportunities to sell carbon reduction credits, and the assessment of the value and integrity of offset projects selling into the California compliance market.
Public Company Reporting Obligations
We counsel clients on U.S. Securities and Exchange Commission requirements related to the reporting of climate-related risks. Our lawyers are also well versed in the voluntary disclosure recommendations of the Task Force on Climate-Related Financial Disclosures, the Sustainability Accounting Standards Board, and the Climate Disclosure Standards Board.
