Jane E. Carmody

Jane assists clients with regulatory compliance and permitting issues under state and federal environmental laws.

Jane Carmody has extensive experience working with federal laws, including the Clean Water Act (CWA), the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), the Federal Power Act, the Atomic Energy Act (AEA), and the Uranium Mill Tailings Radiation Control Act (UMTRCA). Jane also has experience advising clients with cleanup sites and brownfield redevelopment projects under Washington's Model Toxics Control Act (MTCA). In addition, Jane counsels clients on Washington's climate change laws and regulations, including the Climate Commitment Act (CCA), as well as Washington's solid waste management laws and radiation protection regulations.

Jane helps clients navigate enforcement actions undertaken by local, state, and federal agencies. As an extension of her environmental counseling and compliance practice, Jane advises clients on regulatory compliance issues related to the emerging contaminants per- and polyfluoroalkyl substances (PFAS), a rapidly evolving area of the law. Relatedly, Jane also advises clients on environmental regulations and compliance issues for due diligence in support of real estate transactions. 

Jane is also well-versed in various aspects of international environmental law. These include tracking developments related to the International Seabed Authority and regulations relating to deep sea mining. Jane also is knowledgeable about various treaty developments related to the high seas and plastics.

Maintaining an active pro bono practice, Jane works with the Transgender Law Center, responding to letters sent by trans and gender-nonconforming people in prisons and jails requesting legal information and resources.

Jane earned her J.D., with honors, from the University of Washington School of Law, where she served as the associate editor-in-chief for the Washington Law Review. During law school, Jane served as a judicial extern for Judge James L. Robart of the U.S. District Court for the Western District of Washington.

Represented Les Schwab Tire Centers

Represented Les Schwab Tire Centers, a 68-year old family-owned business and leading tire retailer and service center operator, in its sale to Meritage Group.

Benton County Mosquito Control District v. Department of Ecology

Successfully represented a local public health agency regarding a condition in the Aquatic Mosquito Control General Permit. The Pollution Control Hearings Board granted summary judgment on the question of Ecology’s authority to include the condition under the Clean Water Act (CWA) and required removal of the unauthorized condition.
