Perkins Coie Secures Major Win for Ravensburger Against $250M Copyright Infringement Claim
SEATTLE (October 27, 2025) - Perkins Coie is pleased to have represented Ravensburger North America Inc. in securing a major federal court win by defeating a $250 million copyright infringement claim brought by The Upper Deck Company in relation to a trading card game. The outcome represents a significant win for game creators and designers and was one of the largest copyright infringement cases in the country.
After two-and-a-half years of litigation, 25 depositions, the production of thousands of documents, and a summary judgment hearing, the Court dismissed all but one of Upper Deck’s claims, including the copyright claim.
After reviewing all the evidence, the Court concluded that “no reasonable juror could find copyright infringement.” In dismissing the copyright claim, the Court made clear that game mechanics cannot be copyrighted, whether they are characterized as a bundle or an expression. The Court emphasized that “calling unprotectable game mechanics that are standard in [trading card games] ‘expressions’ does not make them so.” With the copyright claim dismissed, the rest of Upper Deck’s case fell apart, and the Court also excluded Upper Deck’s damages expert.
