As one of the firm's premier trial lawyers, Oliver Gold is a natural problem solver with a knack for making complex cases easy to understand.

His recent client successes include obtaining a complete victory for a multinational general contractor against an owner/developer in a 12-week jury trial involving claims for wrongful termination and breach of contract; securing a $42.6 million judgment against the parent company of a real estate developer following a fast track arbitration; securing a complete victory for a manufacturing client as lead trial counsel in a breach of contract action; and helping to secure a take-nothing judgment for a global technology client following trial. Oliver also obtained a favorable settlement in a probate litigation after three weeks of trial; significantly narrowed claims for trade libel, defamation, and false advertising for a voice-over-internet-protocol company on summary judgment and then favorably resolved the remainder of the case on the eve of trial; helped to resolve claims of trademark infringement, false advertising, and patent infringement for a Fortune 500 food manufacturer; and obtained summary judgment in favor of a global talent agency on claims of the Lanham Act and unfair competition violations.

Based in Los Angeles and litigating throughout federal and state courts in California, Oliver Gold represents clients across several industries, including entertainment and media, construction, real estate, and intellectual property. He also routinely assists communications service providers with their analysis and response to requests for disclosure of information consistent with the federal Electronic Communications Privacy Act, including the Stored Communications Act. In this role, Oliver represents providers in their interactions with government and private counsel and litigates user data request issues. He also successfully represented lenders and special servicers of commercial loans in dozens of receivership actions involving a variety of commercial properties throughout California.

Having previously served as in-house counsel for a plant-based food and beverage client on secondment, Oliver has also negotiated and drafted various commercial agreements; navigated regulatory issues and pre-fundraise diligence; and counseled on pre-litigation IP, employment, and shareholder disputes.

Served as a member of team that obtained favorable settlement mid-trial of a family trust dispute, through which client sought to invalidate a restated declaration of her late parents’ family trust and corresponding exercises of the power of appointment based on testator’s lack of testamentary capacity and her brother’s undue influence over his late parents.

SB Manufacturing, LLC v. John Patrick O’Brien, dba Real Rodders Wheels

Superior Court of California, Ventura County
Obtained complete victory as lead trial counsel for automobile wheel manufacturer in an commercial dispute against a former distributor. Victory included entry of judgment in favor of client on breach of contract cause of action and take-nothing judgment on distributor’s cross-complaint for breach of contract and conversion.

Post Consumer Brands, LLC v. General Mills, Inc.

U.S. District Court for the District of Minnesota
Served as a member of a team that successfully defeated motion for preliminary injunction in design patent infringement action on behalf of defendant General Mills. After transfer of the action from the Eastern District of Missouri to the District of Minnesota, conducted two months of expedited discovery relating to plaintiff’s design patent infringement claim. The District of Minnesota denied the motion for preliminary injunction, holding that General Mills had raised a substantial question concerning the validity of plaintiff’s design patent.

Kibler v. Hall, et al.

U.S. District Court for the Eastern District of Michigan
Obtained summary judgment in favor of William Morris Endeavor Entertainment when defending it from claims of violation of the Lanham Act and unfair competition in connection with the use of the name “Logic” by a recording artist.

General Mills India v. Kostas International

U.S. District Court for the Central District of California
Represented General Mills in a trademark infringement action against a distributor of a counterfeit product and helped reach a settlement that included the defendants stipulating to a permanent injunction.

William Morris Endeavor Entertainment, LLC v. Scripps Networks Interactive, Inc.

Superior Court of California, County of Los Angeles
Represented a talent agency in an action seeking package commission fees in connection with the Travel Channel television series “Ghost Adventures.”

Trulia v. Move Sales

Superior Court of California, San Francisco County
Served as a member of team representing Trulia in an action seeking specific performance and an injunction to prevent its competitor, Move Sales, from terminating its daily feed of online listings data for residential properties throughout the United States. Oliver helped to obtain a temporary restraining order and the case settled during hearing on Trulia’s motion for a preliminary injunction.

Dental Works v. Vesta

Superior Court of California, Los Angeles County
Defended Vesta against a putative class action in which named plaintiffs alleged they were charged for wireless phone services that they never authorized in violation of the California Legal Remedies Act and the California Unfair Competition Law (§17200).

General Mills v. Chobani

U.S. District Court for the Northern District of New York
Served as a member of team that represented General Mills in an action for false advertising under the Lanham Act and secured a preliminary injunction for General Mills. This brought to a halt Chobani’s advertising campaign that included defamatory claims against the client’s competing yogurt product.

Kevin Sun, et al. v. HTK Hawaii, Inc. et al.

Superior Court of California, Los Angeles County
Obtained a stay of the case, pending resolution of related out-of-state litigation, in the defense of HTK Hawaii, Inc. in an action for breach of contract and related business torts.
