Mallory Gitt Webster

Mallory represents Fortune 500 and startup clients facing novel and challenging legal problems. 

Mallory Webster defends companies in class-action, commercial, and consumer disputes involving consumer protection and unfair competition claims, dark patterns in marketing, pricing and promotions, false advertising, privacy claims, enforcement of companies' terms of service, defective products, breach of contract, and business torts.

Mallory has deep experience in the emerging area of mass arbitration, a strategy deployed by plaintiffs' firms to file hundreds or thousands of individual arbitration demands to exert disproportionate settlement pressure on companies. She also counsels on updates to companies' dispute resolution terms, strategies to stave off mass arbitration, and best practices for obtaining consumer agreement to terms of service.

Mallory is an exceptional communicator who provides clients outstanding work product and insightful guidance. She is routinely acknowledged by clients, colleagues, and co-counsel for her compelling writing, persuasive oral advocacy, and responsiveness. At every stage of litigation, Mallory focuses on her clients' business, values, and goals to inform strategy. Represented Safeway in putative class action raising consumer-protection claims concerning Safeway’s collection of taxes and secured complete dismissal of claims. 

Shaffer v. Amazon Services LLC

U.S. Bankruptcy Court for the District of Arizona
Defending Amazon in litigation involving breach-of-contract claims related to inventory practices. Matter pending following multiday virtual bench trial.

In re Wyze Data Incident Litigation

U.S. District Court for the Western District of Washington
Represented defendant Wyze, maker of smart home cameras and other devices, in a putative class action based on an alleged data incident affecting Wyze. Successfully moved to compel arbitration of all plaintiffs’ claims.
