Katherine M. Dugdale

Katherine focuses her practice on intellectual property litigation and general commercial litigation.

Katherine Dugdale has particular experience in the area of trademark, copyright and related intellectual property litigation. She has handled copyright and trademark cases throughout the country on behalf of a major software developer. In addition to obtaining summary judgments on copyright and trademark claims, Katherine has obtained contempt orders, temporary restraining orders, preliminary injunctions and asset freezes. She has successfully argued trademark and copyright cases in front of the U.S. Court of Appeals for the Ninth Circuit and the U.S. Court of Appeals for the Second Circuit.

Additional litigation matters that Katherine has handled include successfully defending a national association against the entry of a preliminary injunction, representing a major airline in a commercial software dispute and obtaining summary judgment for claims involving the Digital Millennium Copyright Act (DMCA). She also obtained summary judgment in one of the first civil rulings under the Anticounterfeiting Act of 2004.

In addition to her litigation practice, Katherine has extensive experience counseling clients in a variety of industries on intellectual property, brand protection strategies and right of privacy issues.

Katherine also has an active pro bono practice and has represented clients in immigration and adoption matters.

Successfully represented software developer against distributor of infringing software. 136 F. Supp. 3d 1148 (C.D. Cal. 2015), aff'd, No. 15-56544, 2017 WL 2790693 (9th Cir. June 27, 2017)

Island Software and Computer Services, Inc. v. Microsoft Corporation

Microsoft Corporation v. Image & Business Solutions Inc.

Successfully represented software developer against distributor of infringing software and illicit Certificate of Authenticity labels in one of the first civil rulings under the Anti-Counterfeiting Act of 2004. The court awarded $1,257,500 in damages on summary judgment for trademark and copyright infringement and violation of the Anti-Counterfeiting Act of 2004. 2007 WL 2874430 (C.D. Cal. May 4, 2007)
