Elise is a trial-tested patent litigator who treats damages as a strategy, not an afterthought.

For more than a decade, Elise has guided technology companies through their highest‑stakes disputes in federal courts and at the International Trade Commission, with a particular strength in transforming complex analyses into persuasive narratives that win at summary judgment, at trial, and on appeal. Her technical casework spans semiconductors, networking, voice and video conferencing, AI and machine learning, wireless and life sciences—anchored by a business‑first approach shaped by years managing executive relationships before she became a lawyer.

Elise has delivered successful outcomes for her clients at every stage of litigation. In a 2024 jury trial in the U.S. District Court for the Western District of Texas, she led the damages case from inception, drafted and argued successful Daubert motions, conducted the direct exam of the damages expert, and prepared fact witnesses across the line. These efforts resulted in the court vacating the jury’s damages award. In another matter, she dismantled a nonpracticing entity’s case by uncovering fraudulent patent ownership claims and litigation funding issues resulting in a successful summary judgment of no standing. She has prevailed on Daubert motions excluding every damages theory, prompting settlement. Early in her career, she argued a Markman hearing that invalidated software implemented means‑plus‑function claims, and wrote multiple successful inter partes review and covered business method petitions.

Elise partners closely with experts to model reasonable royalties—including for standard essential patents (SEPs)—and pressure‑test apportionment, license comparability, and marking analyses. She has prepared senior technical and business witnesses for deposition and trial, second‑chaired C‑suite testimony, taken and defended expert depositions, and managed discovery and motion practice end‑to‑end. Beyond IP, she was tapped during the 2020 election cycle to litigate fast‑moving federal, state, and appellate matters to protect the right to vote.

Elise’s pro bono representations have included veterans’ appeals, asylum hearings, and civil rights litigation.
