Catherine Del Prete

An experienced trial and appellate, Catherine has recovered hundreds of millions of dollars for her clients.

Catherine Del Prete litigates in state and federal courts throughout the United States. She represents corporate policyholders in every stage of litigation, from initial claim through trial and appeal. 

Catherine’s practice spans various issues, including complex directors and officers liability and indemnification matters, cyber and privacy breaches, product liability, advertising liability, and long-tail bodily injury. She also assists clients on environmental contamination, large property and casualty losses, business automobile and trucking, employee theft, workers compensation, and nonsubscriber issues. Her experience covers a wide range of industries including retail, technology, food and beverage, life sciences, financial institutions, transportation, and utilities.

 

Additionally, Catherine counsels clients on insurance coverage topics including policy renewals and audits, representation and warranty coverage, and ways to avoid gaps in coverage. Catherine negotiates contracts and crafts customized methods of offsetting clients’ risks. She also advises startups and tech companies on cyber coverage issues. 

In her active pro bono practice, Catherine currently represents a death row inmate in his federal appeal to the U.S. Court of Appeals for the Fifth Circuit. She has achieved favorable outcomes in civil litigation, adoption, guardianship, immigration, and expungement cases.

Experience

  • Trial counsel for a life sciences company in Oregon state court pursuing negligence and fraud claims against an insurance broker related to its procurement of directors’ and officers’ liability coverage.
  • Representation of the Motors Liquidation Company DIP Lenders Trust against 30 excess insurance companies in seeking coverage for underlying claims in excess of $1 billion for historical asbestos and environmental liabilities of pre-bankruptcy General Motors. This was one of the largest coverage actions of record for long tail claims. Motors Liquidation Co. DIP Lenders Trust v. Allianz Ins. Co., C.A. No. N11C-12-022 FSS [CCLD] (Superior Court of Delaware).
  • Representation of debtors in connection with all coverage issues under more than 175 Directors & Officers and Errors & Omissions liability policies with limits in excess of $1 billion dollars. The underlying actions stemmed from the packaging and sale of mortgage backed securities. In re Residential Capital LLC, Case No.: 12-12020 (Mg) U.S. Bankruptcy Court for the Southern District of New York (Largest Chapter 11 Case of 2012)
  • Representation of an automotive products manufacturer in North Carolina state court seeking coverage for thousands of long tail asbestos and benzene products liability claims.
  • Representation of a hotel in multimillion-dollar dispute with carrier for property damage and business interruption claims in the wake of Hurricane Maria.
  • Represented a company seeking social engineering fraud, computer fraud and bank transfer fraud coverage related to a series of fraudulent wire transfers.
  • Represented a tech startup seeking to recover a multimillion-dollar amount in a breach of contract dispute that resulted in full payment.
  • Advises a major consumer electronics manufacturer on a variety of insurance law issues. This has included advice on insurance coverage for claims alleging mass torts and trademark infringement. She also has advised on drafting of insurance provisions in supplier contracts and on the effect of corporate transactions on rights to insurance proceeds.
  • Advises major food producer on a variety of issues relating to insurance coverage, including product liability issues, product recall issues and unfair business competition claims.
