On May 5, 2023, FERC granted in party and denied in party a request by Dynegy Marketing and Trade, LLC seeking to recover $903,339.36 in unrecovered costs it incurred because its resources were subject to market power mitigation in the ISO New England (ISO-NE) real-time energy market on December 24, 2022, as well as associated regulatory costs. FERC also instituted a proceeding under Section 206 of the FPA to examine ISO-NE’s market power mitigation Tariff provisions. On December 12, 2023, the Commission accepted an Upward Mitigation Fix Filing that resolved most of the issues involved in the proceeding. On February 7, 2024, FERC held the show cause proceeding in abeyance pending completion of the stakeholder process through which further revisions to ISO-NE’s Transmission, Markets, and Services Tariff were being proposed and vetted. On July 24, 2024, ISO-NE and the New England Power Pool Participants’ Committee filed revisions to the energy market mitigation rules in Appendix A to Market Rule 1 of its tariff. The revisions address the two remaining outstanding issues: (1) whether certain market power mitigation provision(s)—those that do not allow different fuel prices to apply to different offer segments of the “Reference Level”—are just and reasonable and not unduly discriminatory or preferential, and (2) whether the duration for which a Resource’s Supply Offer is mitigated under the general threshold energy mitigation rules—which is tied to the length of time for which the supplier remains pivotal—is just and reasonable and not unduly discriminatory or preferential. | |

On May 23, 2024, FERC issued a notice of proposed rulemaking (NOPR) amending its regulations to clarify that for all proceedings before FERC that require a water quality certification pursuant to Section 401(a)(1) of the Clean Water Act, “the reasonable period of time during which the certifying authority may act on the water quality certification request is one year from the certifying authority’s receipt of the request.” The proposed rules would also clarify that all FERC “authorizations that have the potential to discharge into waters of the United States require a section 401 water quality certification or waiver, including hydropower exemptions, amendments, and surrenders.” Finally, the proposed rules would provide “updated terminology in [FERC’s] hydropower regulations and update [] the timing of the filing requirements for [FERC’s] expedited hydropower licensing process.” Agenda item H-1 may be an order regarding the NOPR. |

| Elba Liquefaction Company, L.L.C. and Southern LNG Company, L.L.C. On April 28, 2023, Elba Liquefaction Company, L.L.C. and Southern LNG Company, L.L.C. (collectively, Applicants) filed an application requesting amendment of existing authorizations, including approval to: (1) make modifications to ten existing Movable Modular Liquefaction System (MMLS) units; (2) construct and operate a new condensate plant; (3) install three new liquid nitrogen vaporizers; and (4) increase the total liquefaction capacity of the MMLS units from approximately 2.5 to 2.9 million tons per annum to 2.9, within the existing liquefied natural gas terminal in Chatham County, Georgia.
