Musgrave v. Marie Callender's Pie Shops Inc., No 4:14cv2006 (N.D. Cal.): Putative class action for violations of California's UCL, CLRA, and FAL, as well as claims for common law fraud, negligent misrepresentation, breach of express warranty, breach of contract, and unjust enrichment based on allegations that defendants label their muffin mixes as "all natural" when they contain alleged synthetic ingredients such as sodium acid pyrophosphate. Complaint. Ruiz v. Darigold Inc./Northwest Dairy Association, No. 3:14cv2054 (N.D. Cal.): Putative class action under California, Washington, and Oregon's consumer protection statutes, as well as common law claims for fraud by concealment and unjust enrichment based on defendant's representations that it sells milk products that have been produced in an environment that is safe for animals and respectful of workers' rights when, plaintiffs' allege the defendant's labor and production practices are not consistent with these representations. Plaintiff alleges that the defendant's Earth's Best waffle products are misleadingly labeled "all natural" but contain alleged synthetic ingredients such as sodium acid pyrophosphate. Complaint. McMahon v. Bumble Bee Foods, LLC, No. 1:14cv3346 (N.D. Ill.): Putative class action alleging claims under Illinois' Consumer Fraud and Deceptive Business Practice Act, the Illinois FDCA, breach of implied warrant, negligent misrepresentation, negligence, unjust enrichment, and a common count for money paid, claiming that Bumble Bee sold misbranded products - including seafood and tuna products - labeled with unlawful Omega 3 nutrient content claims, and an American Heart Association seal not disclosed as a paid endorsement. Complaint. Morales v. Kraft Foods Group, Inc., No. BC545131 (L.A. Super.): Putative class action alleging claims under California's UCL, FAL, and CLRA for false and misleading advertising of cheese labeled "all natural" despite containing artificial ingredients such as food coloring.
