Consent Judgment Entered in Proposition 65 Action
Consumer Advocacy Grp. v. Olivier Napa Valley, Inc. et al, No. BC580857 (Cal. Super. Ct. - Los Angeles County): The Court granted Plaintiff's unopposed motion for entry of consent judgment in this Proposition 65 action alleging that Defendants' raspberry balsamic vinegar products contain lead. The terms of the settlement are: (1) Defendant is permanently enjoined from selling in California any vinegar product for which the amount of consumption by a typical consumer contains more than 34 ppb of lead per day; (2) Defendant will pay a civil penalty of $10,000; (3) in lieu of a civil penalty, Defendant will pay Plaintiff $7,000; and (4) Defendant will pay attorneys' fees and costs of $38,000.
