Tyler S. Roberts

Tyler Roberts is a litigator, representing companies facing a variety of challenges, including contract disputes; class actions involving data privacy, biometric, and consumer protection issues; and intellectual property (IP) disputes.

Tyler is a strong researcher and writer and has experience with both fact and expert discovery, including taking and defending depositions. Tyler seeks out opportunities to appear in court and has argued motions and served as trial counsel in multimillion-dollar disputes.

Tyler's pro bono work has focused on representing individuals involved in the criminal justice system. He has represented an indigent criminal defendant facing federal drug trafficking charges and was part of a team that drafted a petition habeas corpus and a petition for certiorari for another client who had been convicted of a crime. Tyler was also part of a team that filed an amicus brief in the U.S. Supreme Court addressing a court's misapplication of the harmless error doctrine. In 2015, Tyler received an Outstanding Pro Bono Service Award from the New York State Courts Access to Justice Program for his work with the New York Legal Assistance Group representing low-income defendants against debt collectors.

Prior to joining the firm, Tyler served as a law clerk at the Washington State Attorney General's Office, where he analyzed issues arising under Washington's Consumer Protection Act. He also served as a law clerk at the U.S. Attorney's Office for the Western District of Washington.

Professional Experience

S.A. and P.B. v. University of Washington

Superior Court for the State of Washington, King County
Defended the University of Washington in putative class action arising from an alleged data breach allegedly involving the personal information and protected health information (PHI) of approximately one million University of Washington School of Medicine patients. Plaintiffs asserted multiple statutory and common law claims, including for violation of Washington’s Breach Notice Statute, Uniform Health Care Information Act, AIDS Omnibus Act, and Release of Records for Research Act, as well as for negligence, breach of fiduciary duty, breach of express and implied contract, and unjust enrichment. Perkins Coie achieved dismissal of all claims with statutory damages at the pleadings stage and then twice defeated class certification, after which plaintiffs dismissed all remaining claims with prejudice.

In re National Prescription Opiate Litigation

U.S. District Court for the Northern District of Ohio
Counsel for defendant Costco Wholesale Corporation in numerous cases by municipalities, third-party payors, and other plaintiffs consolidated as MDL No. 2804 and in state courts alleging various claims against manufacturers, distributors, and retail sellers of prescription opioids.
