Emma Roberts

Emma Roberts is an associate with the firm's Privacy & Security Law practice.

She represents online communications and storage providers on various issues, including user data privacy, content moderation, privacy litigation, and incident response.

Emma has defended social media providers, technology companies, and national businesses in litigation and class-action lawsuits regarding terms of use, contractual issues, common law privacy claims, the Illinois Biometric Information Privacy Act (BIPA), and unlawful content moderation claims, as well as defenses under the First Amendment and Section 230 of the Communications Decency Act (CDA). She represents service providers in responding to requests for online user data under the Electronic Communications Privacy Act (ECPA), the Stored Communications Act (SCA), and state equivalents.

Emma also advises clients ranging from local nonprofits to Fortune 100 companies on the protection and use of personal data, including disclosure obligations, security requirements, and data breach notification and response. Her experience in all stages of incident response encompasses data breach detection and forensic investigations, fact gathering, mitigation and prevention efforts, compliance with notice obligations and other legal obligations, and addressing regulatory inquiries following an incident.
