Dmitry Kagan
As a patent attorney with more than 10 years of engineering experience, Dmitry advises a wide range of clients, from early stage startups to Fortune 500 companies, on all aspects of patent portfolio development.
Dmitry Kagan also counsels clients in the identification of strategic areas where patent protection is needed and assists with filing new patent applications to create robust patent portfolios. Dmitry uses a mix of storytelling and teaching approaches to avoid subject matter eligibility issues in patent applications.
Dmitry's practice focuses on technology industries including fintech, artificial intelligence (AI), machine learning (ML), cybersecurity, blockchain and cryptography, cloud computing, virtual reality (VR), augmented reality (AR), networking, and telecommunications. In addition, Dmitry has a vast amount of experience prosecuting patent applications in foreign jurisdictions including Europe, Canada, China, Japan, Australia, and Mexico.
Also experienced in targeted patent prosecution, Dmitry helps clients obtain multiple claim sets that capture an invention from different angles and that are carefully tailored to avoid claim construction issues and design-arounds. In addition, Dmitry is experienced in performing due diligence analysis including infringement analyses of target products, validity/invalidity analysis, and freedom-to-operate analysis.
Dmitry also assists colleagues in patent disputes including drafting inter partes review (IPR), covered business methods (CBM) petitions, invalidity contentions, ineligibility contentions, and expert reports.
