Neal A. Fisher Jr.

Neal guides employers through critical labor and employment issues in California and throughout the country.

Neal A. Fisher Jr. represents employers involved in high-stakes, complex class, collective, and representative actions like those brought pursuant to California's Private Attorneys General Act of 2004; labor arbitrations; FINRA arbitrations; and claims of wrongful discharge, discrimination, retaliation, and disability discrimination, including those brought under Title VII of the Civil Rights Act of 1964, the Family and Medical Leave Act, California Family Rights Act, and California Fair Employment and Housing Act.

Neal regularly litigates in state and federal courts and appears before governmental agencies, such as the California Department of Fair Employment and Housing, Department of Industrial Relations, and Division of Labor Standards Enforcement.

Neal's litigation practice also involves managing a mortgage litigation portfolio that spans several jurisdictions, including Alaska, Oregon, and Washington.

In addition to his litigation work, Neal counsels clients with their hiring needs, termination decisions, strategic restructuring and layoffs, disciplinary issues, medical leaves, employment agreements, and personnel policies. He performs extensive wage and hour audits for clients, troubleshooting, issue spotting, and revising their policies, procedures, and practices to ensure compliance with local, state, and federal laws. His clients' businesses operate across multiple industries and sectors, including banking and financial services, technology, retail, and food and beverage.

Experience

Serco Inc.

Serve as lead counsel for Serco Inc. in state and federal court, on single-plaintiff cases and Private Attorneys General Act (PAGA) representative and wage-and-hour class actions involving thousands of nonexempt employees. These cases range in subject matter from discrimination, harassment, and retaliation matters to disputes regarding expense reimbursements, noncompliant wage statements, off-the-clock work, failure to pay overtime, failure to provide compliant meal and rest breaks, and misclassification claims among others.

CIC Group d/b/a Nooter

Serve as lead counsel for Nooter in a PAGA representative action, involving claims of failure to pay wages, failure to provide accurate wage statements, and unfair business practices, among other claims. 

SGS North American Inc.

Serve as lead counsel for SGS in commercial litigation, defending the company against general negligence claims. 

Baker v. A. J. Frazier, Inc. et al

Defended employer in a wage-and-hour class action, involving claims of failure to pay overtime under state and federal law. 

Tommy Ennis v. Orchard Supply Company, LLC et al

Defended Orchard Supply Company, LLC against employment claims including disability and age discrimination, and failure to accommodate under the FEHA.

Gordon v. Maxim Healthcare Services, Inc.

Represented Maxim Healthcare Services, Inc. in a class action related to failure to pay overtime compensation.*

Lowe’s Home Centers, LLC
Served as lead counsel for Lowe’s. Oversaw, handled, and supervised the company’s litigation docket for single-plaintiff matters in California. These cases involved discrimination, retaliation, and harassment matters, among others.*
