As data breaches and other cybersecurity issues dominate the news, the evolving intersections of data security, privacy, and technology are fraught with legal issues and enterprise risk. Regulators, business leaders, and criminals alike are dedicating substantial resources to this rapidly changing area, and it is increasingly important for lawyers, consultants, and businesses to understand the key legal issues and considerations in the cyberlaw landscape.

This program will discuss the types of key risk assessment and planning steps that companies are taking to address critical cybersecurity issues, as well as the many privacy and remediation considerations that arise in the event of a potentially serious security breach. Drawing from their experience in government, in-house, and as advisors to companies across the country, our panelists will discuss key topics in this fast-evolving area, including:

  • Planning for an (inevitable) breach
  • Evaluating the scope of a cybersecurity issue
  • Perspectives of regulatory bodies on enforcement, both against perpetrators and also against victim companies that arguably could do more to create secure systems that can withstand breach
  • Privacy and notice obligations arising post-breach
