Justin works with clients to craft compliance strategies for the development, deployment, and use of artificial intelligence (AI), machine learning (ML), and computer vision technologies.

Justin Potesta advises companies on biometric privacy, model training and deployment, and AI governance, including matters arising under the Illinois Biometric Information Privacy Act (BIPA), Texas Capture or Use of Biometric Identifier law (CUBI), and AI-specific laws like the Colorado AI Act. Justin’s clients in this area have included companies leveraging AI/ML for identity verification, content generation and moderation, data analysis, and audio transcription and translation. Justin also regularly counsels clients on financial privacy and consumer protection issues, primarily those involving consumer reporting and risk scoring governed by the Fair Credit Reporting Act. In this space, his clients include fintech companies, background check providers, consumer reporting agencies, and digital asset and blockchain companies.

In addition to his role as an advisor, Justin defends clients in class-action litigation regarding a range of privacy issues. He has also represented clients faced with regulatory investigations by the Federal Trade Commission, Consumer Financial Protection Bureau, and state attorneys general.
