Bradley Dlatt

Bradley counsels corporations on complex insurance coverage matters, including analyzing insurance policies and assisting with policy placement and renewals.

Bradley Dlatt has represented corporate policyholders in insurance coverage disputes concerning, among other areas, directors and officers liability, government investigations, toxic tort liability, antitrust litigation, environmental liability, data breach and cyber liability, commercial property damage, business interruption, employment practices liability, employee theft and dishonesty and intellectual property liability.

In addition, Bradley has experience in preparing case strategy, performing legal analysis, building factual records, managing document productions and privilege logs, engaging in written discovery, deposing fact and expert witnesses, preparing expert reports, briefing dispositive motions, settlement negotiations and drafting of settlement agreements and appellate briefing.

In his pro bono practice, Bradley has obtained a grant of asylum for an undocumented mother and child who fled to the United States after being threatened by gang violence in their home country and successfully prosecuted and settled a civil rights claim on behalf of an incarcerated offender.

Professional Experience

Recovery for Asbestos and Other Long-Tail Liability

  • Assisted a multinational conglomerate with securing substantial insurance coverage settlements in connection with tens of thousands of asbestos lawsuits filed against conglomerate’s subsidiary.
  • Advised global oilfield services provider in pursuing coverage for thousands of current and historic asbestos lawsuits filed against one of its subsidiaries.
  • Represented policyholder in coverage dispute arising out of multiple government investigations, class action lawsuits and more than 200 individual lawsuits filed against policyholder arising out of alleged environmental liability connected to client’s historic use of a product containing certain per- and polyfluoroalkyl (PFAS) compounds.

Commercial General Liability

  • Successfully settled an additional insured claim on behalf of a commercial property manager arising out of a roof collapse at a warehouse managed by the client.
  • Represented large department store chain in defending a prior additional insured insurance recovery resulting from a workplace accident.

Property Damage & Business Interruption

  • Advised luxury resort and its private equity fund parent company on coverage for business interruption losses from California wildfires.
  • Counseled property owner and event production company on coverage for hurricane-related property damage and business interruption.

Data Breach, Cyber Risk, and Privacy Liability

  • Representing technology firm in the first known insurance coverage litigation related to a claim involving the Illinois Biometric Information Privacy Act.
  • Served as coverage counsel to health care utilization management and review firm for data privacy and identity theft claim.

Professional Liability

  • Assisted with representation of two of the nation’s largest managed health care companies in coverage disputes related to the Blue Cross Blue Shield Antitrust Litigation.
  • Represented manufacturer and distributor of gaming technology in Nevada federal court and Illinois state court actions seeking errors and omissions and/or commercial general liability coverage for lawsuits filed against the company.

  • Assisted with representation of managed health care company in multiple coverage disputes related to underlying class action lawsuits filed against the company.
  • Represented global piping distributor in coverage dispute resulting from action filed against it by a corporate competitor.
