There is renewed focus on transmission ROFRs as the U.S. Supreme Court considers addressing the constitutionality of Texas’ law restricting development of certain transmission projects to incumbent transmission owners and FERC considers whether to authorize federal ROFRs for certain transmission projects.  Our panel discussed recent developments in this area, the constitutional boundaries for state ROFR laws, and whether transmission ROFRs are warranted as a policy matter.
