Based on 28 U.S.C. § 1782, US district courts are authorized to order testimony or the production of evidence “for use in a proceeding in a foreign or international tribunal.” On June 13, 2022, the US Supreme Court unanimously held in ZF Automotive v. Luxshare that Section 1782 does not authorize discovery for use in private arbitration proceedings.
