Multiple state legislatures are considering bills that would require insurers to provide business interruption coverage for COVID-19-related claims. If a policyholder purchased business interruption coverage, the bills would require coverage for COVID-19 interruptions—regardless of any virus/pandemic exclusions in the policy or requirements that losses result from physical damage to property. Each state’s bill includes an upper limit on the number of full-time employees in order for policyholders to qualify. In addition, Congress is considering the Pandemic Risk Insurance Act, which would provide retroactive coverage for COVID-19 business interruption claims.
