Issue: President Joe Biden defeated former president Donald Trump in Nevada by a margin of more than 33,000 votes. Even though Nevada’s election was free, fair, and secure, Trump’s allies filed a contest challenging the results of the presidential race, raising specious and farfetched allegations of fraud and malfeasance. We represented President Biden’s slate of electors in the contest, arguing that the Republicans’ case was both procedurally and substantively untenable. 

Result: Operating on an accelerated timetable, the Perkins Coie litigation team briefed and filed a thorough motion to dismiss, undertook discovery, and prepared for a merits hearing in only two weeks. The district court rejected the Republicans’ claims in a detailed and lengthy opinion that dismissed the contest outright. The Nevada Supreme Court affirmed our clients’ win on appeal, paving the way for the certification of President Biden’s electoral victory.
