Perkins Team Prevails in Court of Appeals for Microsoft
Partner David A. Perez was mentioned in "App Maker Must Sue Microsoft in Ireland, Says Wash. Panel," an article in Law360,* regarding a three-judge panel's rejection of a smartphone app company's appeal to sue Microsoft in Washington state court. The Perkins Coie team prevailed on behalf of Microsoft.
The panel rejected Culinary Ventures Ltd.'s appeal to revive its suit alleging Microsoft had illegally deleted its Bitemojo restaurant-touring app data from Microsoft's Azure data-storage services. A trial court had tossed the suit because a forum-selection clause in the online subscription agreement signed by the two companies required Culinary Ventures to bring its suit in Ireland.
